Como o julgamento foi discutido sob repercuss\u00e3o geral, a tese firmada orientar\u00e1 o Judici\u00e1rio e a esfera administrativa fiscal de todo o pa\u00eds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Venceu, com seis votos, a proposta do relator, o ministro Dias Toffoli, que se posicionou favoravelmente ao contribuinte. Ele entendeu que a exclus\u00e3o dos cr\u00e9ditos implicaria em uma \u201cdupla onera\u00e7\u00e3o\u201d, pois geraria recolhimento de ICMS no Estado de origem e no Estado de destino.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A tese a ser fixada \u00e9 no sentido de que a imunidade do ICMS relativa ao estado de origem aplicada na opera\u00e7\u00e3o interestadual com combust\u00edveis derivados de petr\u00f3leo (artigo 155, par\u00e1grafo 2\u00ba, inciso X, al\u00ednea b, da Constitui\u00e7\u00e3o Federal) \u201cn\u00e3o enseja a anula\u00e7\u00e3o do cr\u00e9dito do imposto atinente \u00e0s opera\u00e7\u00f5es internas anteriores\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Toffoli foi acompanhado pelos ministros Andr\u00e9 Mendon\u00e7a, Cristiano Zanin, Luiz Fux, Nunes Marques e Gilmar Mendes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assim, ficou vencido o ministro Alexandre de Moraes, que abriu diverg\u00eancia desfavor\u00e1vel ao contribuinte. Para ele, o caso se insere nas exce\u00e7\u00f5es expressas na Constitui\u00e7\u00e3o em rela\u00e7\u00e3o \u00e0 n\u00e3o cumulatividade, cujas consequ\u00eancias s\u00e3o: n\u00e3o implicar cr\u00e9dito para compensa\u00e7\u00e3o com o montante devido nas opera\u00e7\u00f5es ou presta\u00e7\u00f5es seguintes e acarretar a anula\u00e7\u00e3o do cr\u00e9dito relativo \u00e0s opera\u00e7\u00f5es anteriores.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Como tese, sugeriu que \u201ca manuten\u00e7\u00e3o dos cr\u00e9ditos de ICMS relativos \u00e0s opera\u00e7\u00f5es internas anteriores \u00e0 opera\u00e7\u00e3o interestadual com combust\u00edvel derivado de petr\u00f3leo, em que n\u00e3o incide o imposto em favor do estado de origem, \u00e9 poss\u00edvel somente quando expressamente prevista em lei, nos termos do art. 155, \u00a72\u00ba, incisos II e XII, al\u00ednea \u201cf\u201d, da Constitui\u00e7\u00e3o Federal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os ministros Fl\u00e1vio Dino, C\u00e1rmen L\u00facia e Edson Fachin acompanharam a diverg\u00eancia.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Source:&nbsp;<a href=\"https:\/\/www.jota.info\/tributos\" target=\"_blank\" rel=\"noreferrer noopener\">JOTA<\/a><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>O Supremo Tribunal Federal (STF) decidiu pela manuten\u00e7\u00e3o dos cr\u00e9ditos de ICMS sobre a opera\u00e7\u00e3o interna anterior \u00e0 que destine combust\u00edvel derivado de petr\u00f3leo a outro estado.
